General Terms of Trade

1.
Ben Bor maintains its websites as a service to the Internet community. Access to and use of mastercuisine.com are subject to the terms and conditions set forth herein and all applicable laws. Ben Bor may revise these terms and conditions from time to time by updating this posting.

The customer can, within a 14-day period beginning with the receipt of the goods, withdraw from the purchase without mentioning the reasons. In this case the product has to be returned in perfect condition and in the original wrapping by registered parcel. The shipping costs are to be taken in charge by the customer. After receipt of the returned parcel, Ben Bor will immediately, but not later than 30 days after receipt, pay back the already paid amount - all shipping costs and other fees deducted - in form of check or a credit voucher (gift certificate), Shipping costs will in no case be reimbursed.

The customer has to undertake all the necessary steps to receive his parcel. A parcel which has not been claimed for at the postal office by the client (e.g. client is absent for holidays or business or familiar reasons) will be shipped back to BEN BOR SARL. BEN BOR SARL has no obligation to forward the parcel a second time. A second shipping will only be made when the client pays the full shipping costs and all other fees which may rise with this second shipping. In addition to shipping costs and fees an amount of EUR 20.-- will be charged to the client for the second handling of his parcel. The client has to overtake every costs or fees that will arise when a parcel is returned sender; if necessary, BEN BOR SARL will charge them directly to the customer. This will also be the case if the client has not receptioned the parcel or withdrawn his order after the shipping of his products has already taken place.

Explicitely excepted from this right of withdrawing from the purchase are custom-made articles.

Ben Bor guarantees that the descriptions of the presented articles match with the producer's indications. But Ben Bor cannot made responsible for minor changes which do not influence the function of an article. The presented pictures are not binding - minor changes in materials, dimensions, colours or the use of the products can at any time be made. Ben Bor reserves the right to adapt at any time assortment, prices, materials, dimensions or colours of a product to the existing market conditions.

Every customer will get by mail a confirmation of his order, mentioning the article ordered, price and delivery conditions. The shipping costs englobe a supplement for insurance (only when sent with COLISSIMO SUIVI) and packing. If the client does not want his parcel to be insured (in case of lost or damaged parcels), he has the right to tell this to BEN BOR SARL when ordering. In this case the sum for the insurance will be credited to the client.

The stated prices do include all taxes. No VAT will be charged to the client since Ben Bor is not subject to the VAT. In the product prices not included are participation in delivery and wrapping charges, customs and other duties and additional charges for special services (e.g. gift wrapping, express delivery a.s.o.).

Shipping is made at the only risk and responsibility of the client. Shipping costs for parcels which are shipped cash on delivery on client's demand will entirely be taken in charge by the client (shipping costs COLISSIMO SUIVI or PRIORITY plus fees for a cash on delivery parcel).

Ben Bor puts all its effort in a prompt delivery of the merchandise. Is a quick delivery impossible, Ben Bor informs the client at the stated e-mail-address not without mentioning the approximative delivery time.

9.
The shipping of the goods is made at charge and risk of the client. Ben Bor declines all responsabilities for lost or dammaged parcels. In this case the customer is held to inform Ben Bor so that Ben Bor is able to undertake the necessary steps to find the parcel or in case of dammaged parcels to get an indemnification from the shipping agent / LA POSTE. If Ben Bor gets an indemnisation of the shipping agent / La Poste, Ben Bor can reimbourse the client within the limits of the received indemnisation or send him at a replacement product.  The parcels which are shipped with COLISSIMO SUIVI are insured against loss or damage until an amount of EUR 150.--.

10.
The payment of the products ordered must be made either in advance (by credit card or cash before delivery) or - on special request - at the handing over of the goods (cash on delivery). For reasons of safety, Ben Bor does not deliver against invoice abroad.

In case of an obvious product default Ben Bor reserves the right to repair or to replace the product or to make out a credit voucher (gift certificate) to the value of the product.

In order to take data security and confidentiality into account, Ben Bor engages not to pass customer data on to third parties. But the indications made by customers may be used by Ben Bor for internal statistics and/or for the own marketing.

The presented products and its illustrations may not be reproduced, transmitted or otherwise used except as provided herein, independent of the way or the means used, mechanical or electronic, without the express written permission of Ben Bor. All articles are copyrighted or patented; no claim on the copyright, the patent or any other intellectual property can be entered when buying a product, excepted the express concession in the written licence agreement of Ben Bor.

Ben Bor uses reasonable efforts to inform extensively, truthfully and up-to-date about the products offered. But neither Ben Bor nor any party involved in creating, producing or delivering benbor.com shall be liable for any direct, incidental, consequential, indirect or punitive damages arising out of improper use of the products.

15.
Ben Bor declines all responsabilityfor linked sites. The statements made on the linked sites may not correspond to the opinion of Ben Bor.

16.
The General terms of trade can be consulted on the Internet site www.mastercuisine.com. With his order, the customer agrees to them.

17.
Any disputes arising hereunder will be settled before a competent court of law in Le Val d'Ajol, France, the place of business of the company.
